EMPLOYMENT LAW

We represent management in all facets of the employer-employee relationship. Our employment lawyers counsel, train, and litigate all aspects of employment law. We assist clients to avoid litigation by counseling employers in advance of significant employment decisions, and we help our clients design programs and policies to foster positive employee relations.

Our experience includes advice and litigation in employment discrimination cases before the EEOC, state and local human rights commissions, and the courts; arbitration of union grievances; job safety cases before OSHA; minimum wage and overtime audits by Department of Labor Wage and Hour Division and litigation under the Fair Labor Standards Act; cases under the Worker Adjustment and Retraining Notification Act; litigation of employee benefits claims under ERISA; and litigation of claims including wrongful termination, breach of contract, defamation and violations of whistleblower laws. Our team litigates disputes covered by Employment Practices Liability Insurance (EPLI) and has experience as EPL panel counsel to various insurers.

COMMERCIAL LITIGATION

We prosecute and defend claims in a variety of complex business disputes and litigation, which often involve claims made for breach of contract; business torts; intellectual property claims; non-compete, non-solicitation, trade secret, and confidentiality agreements, violations of various state Unfair Trade Practice Acts; fraud, breach of fiduciary and lease disputes. The companies that we have regularly represented include manufacturers; oil and gas service providers and producers; software and telecom firms; restaurant chains; wholesalers and retailers; real estate developers, operators and REITs; health services providers; medical device manufacturers, and a host of professional service entities.

The firm also handles a large volume of business litigation disputes that include claims for breach of contract and contract provisions, including manufacturing and production agreements, executive employment agreements, confidentiality and non-disclosure agreements, corporate and partnership agreements, licensing contracts, insurance agreements, sales contracts, and lease disputes.

We represent companies in commercial and employment class actions and have experience in all aspects of the certification, notice, bifurcated trials on merit phases (or stages) of mass-tort, commercial and injunctive disputes. We have experience administering the claims and settlement aspects of national and statewide class actions.
